The terms and conditions set out here apply between the responsible seller as service provider and the person who makes bookings on the service provider's website on their own responsibility or on behalf of others. The Terms and Conditions apply to tickets, activities and the purchase of other products and services or a combination thereof.

1. responsibilities of the buyer
Before placing an order, the purchaser must read through the essential information on the product in question and familiarise himself with it. The buyer is responsible for ensuring that the purchase meets his or her own requirements. The buyer must also ensure that the information on the confirmation information (sent exclusively by e-mail) corresponds to the order.
You can also register and log in as a user via your social media account (Facebook or Google). If you log in via Facebook or Google, you can use your corresponding login details for your account.
You can change your personal details at any time after logging in in the "My account" section.
2. Lift tickets
There are two ways to purchase a ticket:
a) The purchaser already has a Skidata KeyCard.
The card has a serial number (e.g. 01-1614 71332500 3445 8000-01). This number must be entered in the online payment area of the online shop in order to load the desired ticket onto the KeyCard. The authorisation is loaded onto the KeyCard when it is used for the first time at an access reader.
b) The buyer does not have a Skidata KeyCard.
In this case, a PDF file with QR code is generated at the time of purchase. The PDF must be printed out by the customer or saved on a mobile phone and exchanged for a topped-up KeyTex at the ticket machines of the Mariazeller Bürgeralpe (pick-up function).
The purchaser is not entitled to make several printouts of the same booking confirmation or to duplicate, reproduce or forward the booking confirmation in any form whatsoever. The guest must keep his KeyCard or QR code (pick-up function) safe in order to prevent misuse by third parties.
Tickets are bound to their holder. Season tickets and multi-day tickets of 5 days or more are additionally provided with the user's photo. In the event of misuse, the operator has the right to block the card for the duration of the season without compensation.
3. implementation of your order
After proper online payment, the buyer will receive a payment receipt by e-mail. This receipt contains the purchase details and can be taken to the ski resort.
In the following cases an order is incomplete or invalid:
- The buyer has not received an email confirming receipt or booking.
- The credit card payment has been cancelled for various reasons and has therefore failed.
- The payment is incorrect or incomplete, so that the required amount has not been debited from the account.
- In these cases, the conditional reservation will be cancelled after a short period of time; the sale is therefore invalid.
4. payment process
The webshop uses the payment solution of Adyen. Buyers can make payments either by credit card or by online banking. Third parties are not granted access to the buyer's personal data and credit card number. Adyen uses Secure Socket Layer (SSL) for the transmission of personal information. SSL creates a secure (encrypted) data connection between the buyer's computer and Adyen. This ensures secure data transmission and prevents unauthorised access.
By clicking the "Pay" button, the buyer makes an offer to conclude an e-ticketing contract with the company Mariazeller Bürgeralpe Seilbahnbetriebs GmbH. The latter accepts the offer by sending a confirmation e-mail and activating the ski ticket paid for by the guest on the Mariazeller Bürgeralpe data centre or by sending the QR code required for the pick-up function after positive completion of the payment process. This concludes the e-ticketing contract. The handover takes place at the buyer's by receipt of the booking confirmation. The buyer is solely responsible for a complete and legible printout of the booking confirmation and must carry this printout with him/her during his/her visit to the ski resort for documentation purposes.
5. right of cancellation
If the buyer is unable to keep the booked appointment due to illness or injury, he/she must notify the seller of the cancellation request in writing and with a medical certificate in good time - but no later than 09:00 hrs on the booked date - if he/she otherwise loses his/her right to claim. In this case, a processing fee of € 5.00 per ticket will be charged.
If the buyer is unable to keep the booked appointment for other reasons, he/she must notify the seller in writing of the cancellation request in good time - at the latest, however, 2 working days (Monday-Friday) before the booked appointment - if he/she otherwise loses his/her entitlement to claim. In this case, a processing fee of 10% but at least € 5.00 per ticket will be charged.
The seller is entitled to cancel orders and bookings at any time if the buyer violates or attempts to circumvent the terms of the contract. In the case of minor violations, the seller shall request the buyer once to comply with the terms of the contract. In this case, cancellation is only possible in the event of a further breach. In any case, the intentional false entry of data is not minor.
If the buyer is a consumer, the buyer may withdraw from the online ticket purchase within 14 days without giving reasons in accordance with § 11 para 1 of the Distance Selling and Foreign Transactions Act (FAGG). The period begins on the day on which the buyer receives the booking confirmation by e-mail. The declaration of withdrawal must have the following minimum content:
-Explanation of the withdrawal
-order number
-date of receipt of the booking confirmation by e-mail
-Date of the declaration of withdrawal
-Name and address of the guest
If the purchaser wishes to book an online ticket which entitles him/her to use the lifts and slopes in a period prior to the expiry of the 14-day cancellation period, the purchaser must expressly declare this request for early performance of the contract in accordance with § 10 FAGG. The buyer shall not be entitled to withdraw from the contract if the performance period for the ticket lies entirely within the withdrawal period. Insofar as the Mariazeller Bürgeralpe lifts are ready for service and the respective lift facilities are basically in operation, the guest shall have no right of withdrawal in the event of or due to bad weather, avalanche danger, unforeseen departure of the guest, temporary interruptions of operation, weather-related suspension of operation of individual facilities, closures of individual ski runs, overcrowding of slopes and all circumstances attributable to the sphere of the guest. In these cases, there is no entitlement to a refund and the guest is not released from his payment obligation.
If the ticket is not redeemed on the booked date, the purchaser has neither a claim to rebooking nor a claim to reimbursement of the ticket price.
